1. Acceptance of Terms

By accessing or using Dr Will's Bedtime Stories ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

If you are using the Service on behalf of a minor child, you represent that you are the child's parent or legal guardian and agree to these Terms on behalf of yourself and the child.

2. Description of Service

Dr Will's Bedtime Stories is a subscription-based audio streaming service providing clinically-informed bedtime stories designed by a children's doctor to help children relax and fall asleep. The Service includes:

• Streaming access to audio bedtime stories
• Curated playlists and collections
• Progress tracking and personalisation features
• Parent-managed child accounts
• Ask Dr. Will AI assistant for personalised sleep advice
• Bedtime routine checklists and progress tracking
• Sleep tracking and achievement certificates

Streaming Only: The Service provides streaming access to content only. No content may be downloaded, saved, recorded, or stored locally. All playback occurs via streaming from our servers.

3. Account Registration & Security

3.1 Account Types

• Adult Accounts: For users 18 years or older who accept responsibility for their account
• Child Accounts: Created and managed by a parent/guardian through their adult account

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Immediately notifying us of any unauthorised use

Account Sharing Prohibited: Each account is for personal, non-commercial use by the registered account holder only. Sharing login credentials with others is strictly prohibited.

4. Subscriptions & Payments

4.1 Subscription Tiers

We offer various subscription tiers with different features and story access levels. Details of each tier are available on our pricing page.

4.2 Billing

• Subscriptions are billed on a recurring basis (monthly or annually)
• Payment is due at the start of each billing period
• Prices may change with reasonable notice

4.3 Story Swaps

Certain subscription tiers include a limited number of story swaps per billing period. Unused swaps do not roll over to the next period.

4.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.

5. Intellectual Property

5.1 Copyright Protection

All audio recordings, stories, scripts, narrations, artwork, and website content on Dr Will's Bedtime Stories are protected by copyright under the Copyright, Designs and Patents Act 1988. Copyright in these works vests automatically upon creation and is owned exclusively by Dr Will's Bedtime Stories.

Our content represents years of development by Dr. Will, a children's doctor with decades of clinical experience. This includes our distinctive story structure featuring relaxation exercise introductions, visualization-focused narratives, and emotionally intelligent content design.

5.2 Trademark Rights

The following marks are trademarks or pending trademark applications of Dr Will's Bedtime Stories. We are actively pursuing formal trademark registration in the United Kingdom and other jurisdictions:

• Dr Will's Bedtime Stories™ — our primary service name and brand
• Dr. Will™ — our character name and persona
• Ask Dr. Will™ — our AI-powered sleep advice assistant
• Calm Notes™ — our curated tips and advice feature
• Story Guardian™ — our content protection technology branding
• Dreamer™, Starlight™, Moonbeam™, Dreamland™ — our subscription tier names

The ™ symbol indicates an unregistered trademark claim. Use of these marks without express written permission is prohibited.

5.3 Proprietary Methodology

Our clinically-informed approach to bedtime stories represents our proprietary methodology, including:

• The integration of relaxation exercises and breathing techniques at the start of each story
• Our visualization-focused narrative structure designed to promote calm and sleep
• The therapeutic storytelling approach developed by Dr. Will over decades of clinical practice
• Our bedtime routine framework and achievement-based encouragement system

5.4 Visual Identity

Our logos, subscription tier emblems (Dreamer, Starlight, Moonbeam, Dreamland badges), achievement badge designs, Sleep Star Certificates, website design, and distinctive visual elements are protected intellectual property. Any reproduction, imitation, or use of these elements without permission is prohibited.

5.5 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and stream content through the Service for your personal, non-commercial use only.

5.6 Restrictions

You may NOT:

• Copy, reproduce, or duplicate any content
• Download, record, or capture audio streams
• Distribute, publish, or share content with others
• Modify, adapt, or create derivative works
• Use content for any commercial purpose
• Remove or alter any copyright notices or watermarks
• Imitate our brand, methodology, or distinctive storytelling approach
• Use our trademarks, logos, or visual identity without written permission

6. Content Protection & Audio Watermarking

6.1 Watermarking Technology

Each audio stream is embedded with a unique, inaudible digital watermark that contains:

• Unique playback session identifier
• User account identifier
• Timestamp of playback
• Device information

6.2 Purpose

Watermarking enables us to trace the source of any illegally distributed content back to the specific account and session from which it was recorded or captured. This protects our intellectual property and the livelihood of our creators.

6.3 Playback Logging

We maintain detailed logs of all playback sessions, including IP addresses, device information, timestamps, and watermark signatures. These logs may be used as evidence in copyright enforcement actions.

Violation of these Terms, particularly content protection provisions, may result in:

• Immediate suspension or termination of your account
• Forfeiture of any subscription fees paid
• Permanent ban from the Service

8.2 Legal Action

• Pursuit of civil remedies for copyright infringement
• Statutory damages up to £50,000 per infringed work under UK law
• Recovery of legal costs and fees
• Criminal referral for wilful infringement

8.3 Watermark Tracing

If our content is found being distributed without authorisation (e.g., on file-sharing sites, social media, or other platforms), we will use watermark analysis to identify the source account. The account holder will be held responsible for the infringement regardless of who performed the actual recording or distribution.

10. AI-Generated Content & Advice

10.1 Nature of AI Features

The Ask Dr. Will feature uses artificial intelligence technology to provide personalised guidance and suggestions. Please understand:

• Responses are generated by AI technology, not written personally by Dr. Will
• The AI uses information from your account (such as listener profiles, achievements, and listening history) to personalise its responses
• The AI has access to Dr. Will's philosophy and approach but cannot replicate professional medical judgement

10.2 Limitations of AI Advice

• AI-generated content is for informational purposes only
• It is not a substitute for professional medical, psychological, or parenting advice
• Always consult qualified healthcare professionals for health concerns
• We do not guarantee the accuracy, completeness, or appropriateness of AI responses for your specific situation

10.3 User Responsibility

You are responsible for:

• Evaluating the suitability of any AI-generated advice for your situation
• Not relying solely on AI-generated content for medical or safety decisions
• Reporting any concerning or inappropriate AI responses to our team
• Understanding that AI technology has limitations and may occasionally provide inaccurate information

11. User Conduct

When using the Service, you agree to:

• Provide accurate and complete registration information
• Use the Service only for lawful purposes
• Not interfere with or disrupt the Service or its servers
• Not attempt to gain unauthorised access to any part of the Service
• Comply with all applicable laws and regulations

12. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind
• We do not guarantee uninterrupted or error-free service
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid for the Service in the past 12 months

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

13. Indemnification

You agree to indemnify and hold harmless Dr Will's Bedtime Stories, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content recorded from or distributed from your account

14. Termination

We may suspend or terminate your access to the Service at any time, without prior notice, for any reason, including but not limited to:

• Violation of these Terms
• Suspected fraudulent or illegal activity
• Upon your request
• Extended periods of inactivity

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) shall survive.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

17. Referral Programme

Any registered user — including those on our free Dreamer™ tier — may participate in our referral programme. There is no cap on the number of people you may refer.

17.1 What counts as a qualifying referral

A referral is "qualifying" only when the person you referred (a) signs up using your unique referral link or code, and (b) successfully completes their first paid monthly subscription payment to a paid tier (Starlight™, Dreamland™ or Moonbeam™ Business).

17.2 Rewards for paying subscribers

If you hold an active paid subscription at the time the qualifying referral becomes eligible, your reward is a 25% discount applied to one upcoming month of your subscription. Discounts are queued and applied one per month. The maximum discount that can be applied to any single month is 25%; additional discounts simply roll into subsequent months.

17.3 Welcome reward for referred users

Users who sign up via a valid referral link and subsequently subscribe receive a one-time 25% discount applied to their first month of paid subscription. The discount is applied automatically at checkout, is non-transferable, may only be used once per account, and cannot be combined with other promotion codes on the same checkout session.

17.4 Cash rewards for free users

If you do not hold an active paid subscription, your reward is paid in cash by UK BACS bank transfer: £24 per qualifying Dreamland™ signup and £100 per qualifying Moonbeam™ Business signup. Payouts are processed once your eligible balance reaches a £50 minimum threshold and you have entered valid UK bank details on your Profile. Bank transfers are made monthly at our discretion.

17.5 30-day clawback window

All rewards enter a 30-day clawback period from the date of the referred user's first payment. If the referred user cancels, refunds, charges back or otherwise stops paying within that window, the reward is voided and will not be issued. The 25% welcome discount in 17.3 is applied immediately at checkout and is not subject to clawback against the referred user, but the corresponding referrer reward is.

17.6 Eligibility and abuse

You may not refer yourself, household members on a shared payment method, or use deceptive, automated or fraudulent means to generate referrals. We may, at our sole discretion and without notice, void rewards, suspend payouts, recover paid amounts and/or terminate accounts that breach these terms or that we reasonably suspect of abuse.

17.7 Tax

Cash rewards are paid gross of any tax. You are responsible for declaring and paying any income tax, National Insurance or other taxes due on amounts you receive. We do not provide tax advice.

17.8 Programme changes

We may change reward amounts, qualifying tiers, the clawback period, the minimum payout threshold or terminate the programme at any time. Changes apply to referrals that qualify after the change takes effect; rewards already eligible at the time of change are honoured under the prior terms.
